A couple should be able to intimately share naked pictures of each other if they so choose.Sexting among adults is unquestionably protected expression under the First Amendment.At that point, sexting is neither consensual nor innocuous.One may have any number of personal objections to sexting, but as long as sexted images are taken voluntarily and shared consensually, it is none of the government’s business.
Same-sex sexual activity is legal in Washington, and the state recognizes same-sex marriages.
5, 2015: Samuel Benda, now 21, was charged in 2011 with possession of child pornography for having a nude photo of his 17-year-old high school girlfriend on his cellphone, taken on the night of their prom.
Benda pleaded guilty to the charge in November 2012. The charge was dismissed in July 2014 after he successfully completed two years of probation.
